NPPEF’s Case Regarding Mail-in Ballots is Named Top 1 Election Litigation Case Implicating the Rule of Law in 2024 by Just Security

In the lead-up to the 2024 election, hundreds of election-related lawsuits brought across the country present a complex litigation landscape well before all ballots are cast and counted.

In a top 10 list, Just Security identifies the most important of these hundreds of cases for their rule of law implications and to convey an overall sense of the election litigation landscape. At the top of their list, is New PA Project Education Fund’s case regarding mail-in ballots.

While it’s disappointing that our motion for review was denied, the Pennsylvania Supreme Court still has not ruled on the merits of our argument that enforcing the handwritten date rule violates voters’ constitutional rights. We hope that, when the next case is before them on this issue, they’ll consider the important constitutional issue at stake.

Make no mistake: That day could and should come very soon. The next appeal raising this issue is already working its way up from the Philadelphia Court of Common Pleas.
